Terms of Service
These Terms of Service (“Terms”) govern all services provided by AZ Window Services (“Company,” “we,” “us,” or “our”) to any customer (“Client,” “you,” or “your”). By scheduling, approving, or allowing work to be performed, you agree to these Terms.
1. Scope of Services
AZ Window Services provides professional residential and commercial services including, but not limited to:
- Window Cleaning
- Window Tinting & Window Films
- Smart Glass / Switchable Film
- Pressure Washing
- Surface, Glass, and Exterior Care
Services are performed based on the written or verbal agreement, estimate, or invoice provided.
2. Estimates & Pricing
All estimates are based on visible conditions and information provided at the time of inspection. Pricing may change if:
- Additional windows, surfaces, or areas are discovered
- Conditions differ from what was represented
- Access, contamination, or obstruction increases labor
Any material change will be approved with the Client before proceeding.
3. Deposits & Payments
- Smart Tint, Window Tinting, and Custom Film require a deposit before scheduling.
- Deposits are non-refundable once materials are ordered or time is reserved.
- Full payment is due immediately upon completion unless otherwise agreed in writing.
Late payments may result in:
- Job stoppage
- Cancellation of warranty
- Collections, liens, or legal action
4. Scheduling & Cancellations
Appointments may be rescheduled due to weather, equipment, staffing, or safety.
If the Client cancels or reschedules within 48 hours of the appointment:
- A cancellation fee may apply
- Deposits are forfeited
5. Client Responsibilities
The Client must:
- Provide safe, legal access to all work areas
- Secure pets and valuables
- Remove fragile or obstructing items
- Ensure power access for Smart Tint and film systems
AZ Window Services is not responsible for delays or damage caused by failure to meet these requirements.
6. Surface & Glass Condition
We do not assume responsibility for pre-existing conditions including but not limited to:
- Scratched, oxidized, etched, or brittle glass
- Failed window seals
- Improperly installed or tempered glass
- Low-E coatings or manufacturing defects
- Old caulking, frames, or gaskets
Cleaning, tinting, or pressure washing may expose or reveal existing defects.
7. Tinting & Film Limitations
Window film performance depends on:
- Glass type
- Installation conditions
- Environmental exposure
AZ Window Services is not responsible for:
- Thermal stress cracks
- Glass breakage
- Building code or HOA restrictions
- Manufacturer defects (covered only by manufacturer warranty)
8. Smart Tint / Switchable Film
Smart Glass systems are custom, electrically powered products.
The Client agrees:
- Installation must not be modified by third parties
- Electrical components must not be altered
- Warranty is void if altered, misused, or improperly powered
AZ Window Services is not liable for damage caused by:
- Power surges
- Building electrical faults
- Improper use
9. Warranty
Labor is warranted for workmanship only.
Materials are covered only by their respective manufacturers.
We do not warranty:
- Damage from heat, moisture, impact, or building movement
- Normal wear and tear
- Failure caused by improper cleaning or third-party work
10. Liability Limitation
AZ Window Services’ maximum liability is limited to the amount paid for the specific service performed.
We are not liable for:
- Indirect, incidental, or consequential damages
- Lost profits, business interruption, or aesthetic changes
11. Refusal of Service
We reserve the right to refuse or stop work if:
- Conditions are unsafe
- The Client is abusive, threatening, or unreasonable
- Payment terms are violated
12. Legal Jurisdiction
These Terms are governed by the laws of the State of Arizona. Any dispute must be resolved in Arizona courts.
13. Acceptance
By scheduling, approving, or paying for service, the Client acknowledges and agrees to these Terms.
